What is a Legal Document Assistant?

 

A Legal Document Assistant (LDA) is an individual registered with the county to assist the public in preparing legal forms for compensation.

 

 

Can a Legal Document Assistant give legal advice?

 

No, LDAs are forbidden to give legal advice. They can only assist with the preparation of forms. They may not advice you of your legal rights or how the law applies to your situation.

 

 

Why would I use an LDA instead of a lawyer?

 

Depending on your circumstances, you may need a lawyer. However, sometimes representation is not needed or there are those confident in representing themselves but not enough to prepare their forms. These people do not need to hire an attorney but do need some help in getting their paperwork in order. In these situations, an LDA will be able to assist them in preparing their forms properly and not have the expense of hiring a lawyer.

 

 

What is required to be a Legal Document Assistant?

 

They must meet minimum educational requirements, secure a bond, and register with the county in which they will be providing service. California Business and Professions Code §6400 and following establish these requirements.

 

 

How can I tell if someone is a legitimate Legal Document Assistant and not doing work illegally?

 

A lawfully registered Legal Document Assistant will have a photo ID from the county they are registered. They must also have their registration number on all forms of publication.

 

 

What is the difference between an Attorney, a LDA, and a UDA?

 

An Attorney is a member of the state bar and lawfully able to provide legal advice and represent clients in all legal matters.

 

 A Legal Document Assistant (LDA) is not a member of the state bar but is registered with the county in accordance to state law and able to assist in filling out legal forms but may not provide legal advice nor represent clients.

 

An Unlawful Detainer Assistant (UDA) is registered within the county they provide service, may assist in filling out eviction forms, and provide legal advice only in matters related to an Unlawful Detainer action. Due to the extended assistance provided they must also be identified on all Unlawful Detainer forms.
